PARTICIPANT RELEASE AND WAIVER OF LIABILITY
Entity Name: Sektor JC LLC dba Sektor Jiu Jitsu Riverside
Affiliates: All Sektor BJJ locations, owners, instructors, employees, and agents (collectively, "Sektor Affiliates").
1. Assumption of Risk
I, {name}, understand the Brazilian Jiu Jitsu (BJJ) and martial arts training are inherently high-risk activities. I acknowledge that participation involves intense physical contact and risks including, but not limited to, strains, fractures, concussions, permanent disability, and death. I voluntarily and knowingly assume all risks, both known and unknown, even those arising from the negligence of the Releasees.
2. Release and Waiver of Liability; No Recovery for Economic Loss
I, for myself and on behalf of my heirs and assigns, hereby release and forever discharge Sektor JC LLC, Sektor Jiu Jitsu Riverside, and all Sektor Affiliates from any and all claims, demands, or causes of action.
Specifically, I waive any right to seek recovery for economic damages, including but not limited to: Loss of current wages of salary; Loss of future earning capacity or "ability to earn a living"; Loss of business opportunities or professional advancement; Disability or vocational rehabilitation costs.
I acknowledge that an injury sustained during training may prevent me from performing my professional duties, and I voluntarily accept the full financial risk of any such interruption to my employment or business.
3. Indemnification and Hold Harmless
I agree to protect Sektor Affiliates from any losses or costs resulting from my participation or any legal claims made by me or on my behalf.
4. Medical Consent & Responsibility
I confirm I am in good health for training. I authorize staff to get emergency medical treatment if I'm injured. I am responsible for all medical costs.
5. Media Release
I allow Sektor Jiu Jitsu Riverside to use my image and voice for marketing without payment.
6. Acknowledgement of Understanding
I understand I am giving up my legal rights, including the right to sue, by signing this waiver voluntarily.
7. Severability
The undersigned further expressly agrees that this waiver and assumption of risk agreement is intended to be as broad and inclusive as is permitted by the laws of the State of California. If any portion of this Agreement is held to be invalid, illegal, or unenforceable for any reason by a court of competent jurisdiction, that specific provision shall be deemed severed from this agreement.
The invalidity of such provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full legal force and effect. Furthermore, any such invalid provision shall be interpreted or modified to the minimum extent necessary to make it enforceable while maintaining the original intent of the parties.
